Listerman and Associates Terms and Conditions

For those who have established a credit with our firm, the terms are net 30 days.  Otherwise, terms are Persons wishing to establish credit can fill out a credit application and a blanket certificate of exemption.  Overdue accounts will be charged interest at the rate of 2% per month or 24% annually.

Prices:

Prices are based on current market value conditions and can change without notice.  All plants are sold FOB from corresponding nursery and are for wholesale trade only.

Guarantee:

We take extra steps to ensure that each load is of the highest quality and correct quantities.  However, errors do occur.  Please notify our office within 24 hours to report any concerns when leaving the nursery.  Plants are warranted to be true to name and in good, healthy condition when leaving the nursery.  All sales are made within the understanding that we shall not be liable for any damage or loss resulting from unloading, handling or transplanting.  We are not responsible for any natural, consequential or incidental damage incurred by the buyer.  All claims must be made within 24 hours of receipt of material.  Packing slips do not always come back to our office, so notations on a packing slip will not be considered as notification.  CLAIMS WILL ONLY BE CONSIDERED IF FAXED NOTIFICATION IS RECEIVED AT OUR OFFICE WITHIN 24 HOURS (937-426-3769).  In any case we will not be liable for any sum greater than the original purchase price.

Cancellations will not be accepted once plant material has been dug.  The cancellation of all orders must be done in writing.  All cancellations are subject to restocking and handling fees.

Shipping:

We strive to consistently deliver what you need, when you need it and where you need it.  Trucks are usually available for delivery of your nursery stock at reasonable rates in either full or split load quantities.  Combination loads can generally be arranged.  Please specify delivery instructions when ordering plant material.  ALL GOODS TRAVEL AT THE EXPENSE AND RISK OF PURCHASER.
